End User Licence Agreement

This licence is between you and QBod LLC, not Apple or Google. It covers the QBod app on your phone and watch. Our Terms of Service cover the service itself; if the two disagree, the Terms of Service apply.

Consumer guarantees

If you are in Australia, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in this licence excludes, restricts or changes those guarantees or any other right you have under consumer law where you live.

1. Your licence

We let you install and use the QBod app on devices you own or control, for your own personal use. You can't sell, rent or share the app, copy or modify it, reverse-engineer it, or use it to build a competing product.

2. Apple and Google

If you downloaded QBod from the App Store: Apple is not responsible for the app or its support, and has no warranty obligation except, if the app fails to meet any warranty that applies, to refund the purchase price as Apple's rules allow. Apple and its subsidiaries can enforce this licence as third-party beneficiaries. If you downloaded it from Google Play, Google Play's terms also apply.

3. Updates

We release updates to fix problems and improve QBod. Some updates are needed to keep using the app, for example when an older version stops being safe or supported.

4. Ownership

QBod, Coach Q, Q-Score and the app belong to QBod LLC or the people who license them to us.

5. Ending the licence

You can stop at any time by deleting the app (deleting the app doesn't delete your account or cancel your subscription). We can end the licence if you break it; see the Terms of Service, section 9.

6. Responsibility

The app is provided with care and skill, but we can't promise it will always be free of errors. Our responsibility is limited as set out in the Terms of Service, section 10, and never in a way that removes your consumer-law rights.

7. Law and export

The Terms of Service, section 11, sets which law applies and where disputes go. You confirm you're not in a country or on a list that US export law bars from using the app.
